Golfed Monthly Sweepstakes
The Golfed Monthly Sweepstakes (the "Sweepstakes") is conducted as a series of separate monthly drawings, each of which constitutes a distinct sweepstakes governed by these Official Rules.
1.Sponsor
The Sweepstakes is sponsored by Golfed LLC, 30 N Gould St, Ste N, Sheridan, WY 82801 ("Sponsor"). The Sweepstakes is in no way sponsored, endorsed, administered by, or associated with Apple Inc., Google LLC, Acushnet Company, Titleist, or any other third party.
2.Eligibility
The Sweepstakes is open only to legal residents of the fifty (50) United States and the District of Columbia who are eighteen (18) years of age or older at the time of entry. The Sweepstakes is void in Puerto Rico, all US territories and possessions, outside the United States, and where prohibited or restricted by law. Employees, officers, directors, and agents of Sponsor, their immediate family members (spouse, parent, child, sibling, and their respective spouses, regardless of where they reside), and persons living in the same household as such individuals (whether related or not) are not eligible.
By entering, participants agree to be bound by these Official Rules and the decisions of Sponsor, which are final and binding in all matters relating to the Sweepstakes.
3.Sweepstakes Period
Each monthly Sweepstakes drawing constitutes a separate Sweepstakes. Each monthly Sweepstakes period begins on the first day of the calendar month at 12:00 a.m. Eastern Time and ends on the last day of that calendar month at 11:59 p.m. Eastern Time ("Sweepstakes Period"). Sponsor's computer is the official time-keeping device for the Sweepstakes.
4.How to Enter
There are two (2) methods of entry. No purchase or paid subscription is required for either method.
Method 1: Complete Monthly Challenges In-App
During the applicable Sweepstakes Period, complete all three (3) monthly challenges available in the Golfed mobile application. Each user who completes all three (3) monthly challenges within a Sweepstakes Period will automatically receive one (1) entry into that month's drawing.
Method 2: Free Mail-In Entry (Alternate Method of Entry)
To enter without using the Golfed app, hand-print your full name, complete mailing address, email address, date of birth, and the words "Golfed Monthly Sweepstakes" on a 3" x 5" card and mail it in a properly stamped envelope to: Golfed LLC, Attn: Sweepstakes Entry, 30 N Gould St, Ste N, Sheridan, WY 82801. Mail-in entries must be received no later than the last day of the applicable Sweepstakes Period to be included in that month's drawing. Mail-in entries received after the close of a Sweepstakes Period will be entered into the next month's drawing. Limit: one (1) mail-in entry per envelope; multiple entries in a single envelope will be disqualified.
Entry Limit
Limit one (1) entry per person per monthly Sweepstakes Period, regardless of method of entry. Entries that exceed the stated limit will be void.
Use of paid Golfed Pro subscription does not increase chances of winning and is not required for entry. All entry methods carry equal weight.
5.Prize
One (1) winner per monthly Sweepstakes Period will receive one (1) box (twelve balls) of Titleist Pro V1 golf balls customized with the Golfed logo (the "Prize"). Approximate retail value (ARV) of the Prize: $75.00 USD.
The Prize is non-transferable. No substitution, cash equivalent, or exchange of the Prize is permitted, except at Sponsor's sole discretion. Sponsor reserves the right to substitute a prize of equal or greater value if the advertised Prize becomes unavailable for any reason.
6.Winner Selection and Notification
Within seven (7) business days following the close of each Sweepstakes Period, one (1) potential winner will be selected at random from among all eligible entries received during that Sweepstakes Period using Random.org or an equivalent verifiable random number generator.
The potential winner will be notified by (a) email sent to the email address associated with the winner's Golfed account or the email address provided on a mail-in entry, and (b) in-app notification (where applicable). The potential winner must respond to the notification and provide a valid US mailing address within seven (7) days of the date the notification is sent.
If the potential winner: (i) cannot be reached, (ii) fails to respond within the response period, (iii) is found to be ineligible, (iv) declines the Prize, or (v) fails to provide a valid US mailing address, the Prize will be forfeited and Sponsor reserves the right, in its sole discretion, to select an alternate winner from the remaining eligible entries or to leave the Prize unawarded for that Sweepstakes Period.
Sponsor may, at its discretion, require the winner to sign and return an affidavit of eligibility, a liability release, and a publicity release (where lawful) before the Prize is awarded.
7.Odds of Winning
Odds of winning depend on the number of eligible entries received during each Sweepstakes Period.
8.Prize Delivery
Prizes will be shipped via United States Postal Service to a valid US mailing address provided by the winner. Sponsor is not responsible for prizes lost, stolen, damaged, delayed, or undeliverable due to incorrect or incomplete address information provided by the winner. Allow approximately four (4) weeks from confirmation of shipping address for delivery.
9.Taxes
All federal, state, and local taxes, if any, associated with receipt or use of the Prize are the sole responsibility of the winner. Sponsor will issue an IRS Form 1099 to the winner if the value of prizes awarded to that winner in a calendar year exceeds applicable IRS reporting thresholds.
10.Publicity Release
Except where prohibited by law, by accepting the Prize the winner consents to Sponsor's use of the winner's first name, username, and city/state of residence for promotional, advertising, and publicity purposes in any media now known or hereafter devised, worldwide, in perpetuity, without further compensation, notification, review, or permission. Where required by law, Sponsor will obtain such consent in writing prior to use.
11.Privacy
Personal information collected from entrants will be processed in accordance with Sponsor's Privacy Policy, available at https://golfedapp.com/privacy. By entering, you consent to Sponsor's collection, use, and disclosure of your personal information in connection with the Sweepstakes as described in the Privacy Policy. Mailing addresses collected from winners are used solely for the purpose of shipping the Prize and will be deleted within ninety (90) days of shipment, except as required by law.
12.Errors, Disqualification, and Fraud
Sponsor reserves the right, in its sole discretion, to disqualify any entrant found, or reasonably suspected, to be (a) tampering with the entry process or the operation of the Sweepstakes; (b) violating these Official Rules; (c) acting in an unsportsmanlike or disruptive manner; or (d) attempting to enter by means other than as permitted under these Official Rules, including but not limited to use of bots, scripts, automated entry, or multiple accounts.
Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law. Should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.
13.General Conditions
Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Sweepstakes if circumstances arise that, in Sponsor's reasonable judgment, materially affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes.
Sponsor is not responsible for: (a) any technical, hardware, software, telephone, network, electronic, or computer malfunctions, errors, or failures, including any injury or damage to entrant's or any other person's device related to or resulting from participation in the Sweepstakes; (b) printing, typographical, administrative, or technological errors in any materials associated with the Sweepstakes; or (c) any incorrect or inaccurate information, whether caused by users, equipment, or programming associated with the Sweepstakes.
By entering, entrants agree to release, indemnify, and hold harmless Sponsor and its officers, directors, employees, agents, and affiliates from any and all liability for any injuries, loss, damage, or claim of any kind arising from or in connection with the Sweepstakes, the Prize, or the acceptance, use, or misuse of the Prize.
14.Limitation of Liability
To the fullest extent permitted by applicable law, in no event will Sponsor be liable for any damages of any kind arising from or in connection with the Sweepstakes, including without limitation direct, indirect, incidental, consequential, special, exemplary, or punitive damages. Sponsor's total aggregate liability to any entrant in connection with the Sweepstakes will not exceed the approximate retail value of the Prize ($75.00 USD).
15.Dispute Resolution; Governing Law
These Official Rules are governed by the laws of the State of Wyoming, without regard to its conflict of law principles. Except where prohibited by law, any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes, or any Prize awarded, will be resolved individually, without resort to any form of class action, in accordance with the dispute resolution provisions set forth in the Golfed Terms of Service, available at https://golfedapp.com/terms. Entrants expressly waive any right to participate in a class action or representative proceeding with respect to any dispute arising under or relating to this Sweepstakes.
No claim or cause of action arising out of or relating to this Sweepstakes may be brought more than one (1) year after such claim or cause of action arose. Claims relating to the intellectual property rights of Sponsor are excluded from the foregoing arbitration requirement.
16.Winners List
A list of winners for past monthly Sweepstakes (covering the prior six (6) months) is available at https://golfedapp.com/winners. Alternatively, you may request a winners list by sending a self-addressed stamped envelope to: Golfed LLC, Attn: Sweepstakes Winners List, 30 N Gould St, Ste N, Sheridan, WY 82801. Requests must be received within six (6) months following the close of the applicable Sweepstakes Period.
17.Severability
If any provision of these Official Rules is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
